# Prohibited Activities / Businesses

> Activities, products, and services considered prohibited under xPay's terms of service.

The activities, products, and services listed below are considered "Prohibited Activities / Businesses" for the purposes of xPay's services.

By using xPay's services, each Seller or Merchant confirms that it does not, and will not, engage in any of the Prohibited Activity / Business. xPay may immediately reject, suspend, or offboard any Seller / Merchant found to be engaged in a Prohibited Activity / Business.

xPay may also recover from the Seller or Merchant any losses, costs, damages, fines, penalties, or other amounts incurred as a result of:

* Any court or regulatory action; or
* Any action or penalty imposed by a card network, payment service provider, or other payment partner in connection with engagement in such Prohibited Activity / Business by the Merchant / Seller. xPay may recover these amounts by deducting them from any current or future payments due to the Seller or Merchant, or by issuing a separate demand for payment.

## Prohibited Activities / Businesses

* Gambling and betting
* Real money online games
* Unlicensed lotteries
* Alcohol or alcoholic beverages, tobacco, cigarettes and related products
* Body parts, including organs
* Pornographic or adult content, including child sexual abuse material or child pornography
* Escort or prostitution services
* Illegal drugs, narcotics, psychotropic substances, or other controlled substances
* Live animals and hides / skin / teeth / nails and other parts of animals
* Fake documents or government IDs
* Firearms, ammunition, explosives, regulated corrosive substances, toxic substances, or weapons sold without appropriate licences
* Counterfeit or infringing goods or content, including unauthorised copies of copyrighted media including books
* Unauthorised copies of software, video games or other licensed or protected materials
* Copyright unlocking devices, hacking or cracking tools or software
* Miracle cures or remedies, marketed as quick health fixes
* Offensive goods, literature or other media, which (a) defame or slander any person or group of persons; (b) encourage or incite violence; or (c) promotes hatred
* Insurance policies and investment products and schemes
* Unregulated financial, investment, or money circulation schemes
* Cryptocurrency, virtual currencies, and other virtual digital assets
* Multi-level marketing collecting fees
* Currency or currency derivatives or other capital transactions
* Any product or service which is not in compliance with all applicable laws and regulations whether federal, state, local or international
* Any products / services that have the potential of casting xPay in a poor light and / or that may be prone to buy and deny attitude of the cardholders when billed and thus leading to chargeback and fraud losses
* Products / services / activities that are either prohibited by any regulator having jurisdiction over the relevant activity / product / service, or operated without appropriate licenses / authorisation from such regulator
* Any other product / service / activity prohibited under applicable law in the jurisdiction of the seller or the buyer
